怎麼翻 Legitimate Rape ？

Legitimate Rape，國內譯成「合法強暴」、「正當強暴」、「真正的強暴」，並且直接翻譯新聞，我不認為台灣讀者能讀懂來龍去脈。

rape 在美國聯邦法律上，分成兩種：
1. forcible rape（強制性交）：使用暴力或威脅之非合意性交。
2. statutory rape（法定強制性交）：與低於某年齡的未成年人性交（視各州而定，但多約12-18歲間）。有時與無行為能力人、心神喪失之人性交也會被認定為法定強制性交。

本爭議源於參議員候選人 Akin 先生試圖限縮美國聯邦法上有關墮胎的規定。現行墮胎規定由 Hyde Amendment 管轄，美國國會自 2011 年起開始討論修正 Hyde Amendment 的範圍，原本因強暴而准許墮胎者，僅限於 forcible rape，國會擬刪除「forcible」，以擴大適用範圍，包括婚內強暴等都納入之。此外，在美國墮胎是由納稅人付款。

此議員便認為範圍過廣，因此欲將其限縮，而有「legitimate rape」的論點，他引用古老的英國醫學理論，女性須達到高潮才能受孕，否則在被強迫的情況下，因不能高潮而無法受孕，是以可將這些人排除，讓其自行負擔墮胎費。此為保守派多年以來的想法。然而，這觀念已被現代醫學排除。

根據該論點，其假定「一個女人被強暴而懷孕，她就不是被強暴」，因為她「必然達到高潮方能受孕」，既然「能有高潮，即表示未違反其意願」。

legitimate rape 是這位議員自創的新字，在 urban dictionary 中，其解釋為「一男一女間未婚或不認識而發生之強暴，乃由 共和黨就強暴作成的唯一解」。

在失言風波後，Akin 議員有如下表態：
「"In reviewing my off-the-cuff remarks, it’s clear that I misspoke in this interview, and it does not reflect the deep empathy I hold for the thousands of women who are raped and abused every year,I recognize that abortion, and particularly in the case of rape, is a very emotionally charged issue. But I believe deeply in the protection of all life, and I do not believe that harming another innocent victim is the right course of action.”」

大意是他承認失言，且他認為因強暴而發生之墮胎是高度爭議的問題，但他深深認為這是保護所有的生命，而且他不認為傷害另一條無辜的生命是正確的做法。

他也表示：
「If it’s a legitimate rape, the female body has ways to try to shut that whole thing down. But let’s assume that maybe that didn’t work or something: I think there should be some punishment, but the punishment ought to be of the rapist, and not attacking the child. 」

若是 legitimate rape，女性身體會自動關閉所有機制，假定沒有自動關閉而受孕，確實要有處罰，但這處罰應該是加害人，而非攻擊無辜的孩子。

因此，我們可以隱約得知，他所謂的「legitimate rape」，似乎有「法律定義之強暴」的傾向，亦即「法律上規定之強暴」。

他顯然不認同因強暴而墮胎這件事，也否認 rape 在美國法上的分類。

我們很難去翻譯「legitimate rape」，因其背後含有許多歷史因素，我認為新聞當中或許更應探討這些事實。假設真要翻譯，我認為這樣比較妥當：「美參議員：遭強暴而受孕者，不准墮胎」。
